The gavel on a special session to deal with the rising cost of medical malpractice insurance in the Cowboy State comes down this morning.

What was expected to be a contentious session and perhaps a stampede to throw money at the problem of rising insurance rates became a more subdued session after three proposals to subsidize doctors failed in committee last week.

Gov. Dave Freudenthal had imprudently proposed giving up to $35,000 apiece to doctors even though he knew it was a short-term fix at best. Wisely enough, legislators saw that giving money to physicians — be it $3,500 or $35,000 — for two years was like stuffing money into a garbage can and watching it be hauled off to the landfill to be buried and never seen again.

The idea of subsidizing doctors was ludicrous. Especially when one considers that the average practice in the Mountain West produced revenues of $387,500 and compensation of $170,000 in 2002, according to Medical Economics.

Knowing how much doctors were going to get in subsidy, there was nothing that could have stopped the insurance companies from raising malpractice rates by whatever subsidy was approved. Besides, what would subsidies really have done to keep doctors in Wyoming? Nothing.

That doesn’t mean there won’t be fireworks this week.

Legislators will get a second chance to vote on a proposed constitutional amendment that would remove the prohibition on caps on damages and allow the Legislature to debate whether there should be limits on non-economic damages.

Of course, the voters would have to approve the amendment before that debate can begin. If this state is going to have a serious discussion on caps, the debate needs to be no strings attached, which is why we supported the proposed amendment.

On one hand, doctors are screaming that they are being forced to change practices, careers or move to another state because of the high cost of insurance. On the other hand, lawyers say the Legislature shouldn’t be taking rights away from citizens by placing caps on malpractice awards. So opening the debate on caps would be a good thing.

Even better is the proposal to study the long-term solutions to malpractice insurance rather than simply jumping at something — anything — as we feared might happen with this special session.

The Appropriations Committee wants to study: a need for medical errors and compensation commission; a form of self-insurance known as risk retention groups; a fund to pay medical liabilities above a certain amount; and the potential impact on the state at various caps on the amount of non-economic damages
